Overview
Cody Madison concentrates his practice on patent litigation, prosecution, and strategic counseling in various technology areas, including pharmaceutical, biotechnology, life sciences, inorganic and organic chemistry, computer software, mechanical engineering, medical devices, cosmetics, and industrial engineering.
Cody has represented clients in patent litigation matters in federal district courts and the United States Court of Appeals for the Federal Circuit. Cody also has experience in Inter-Partes Review proceedings before the Patent Trial and Appeal Board of the USPTO.
Cody’s clients range from early stage and venture-funded start-ups to universities and publicly traded companies. Cody works closely with clients to develop a strong patent strategy in the United States and internationally. Cody has expertise in advising clients and investment firms regarding patent litigation strategy, patent portfolio acquisitions, product development, and potential market expansion opportunities. Cody has extensive experience consulting clients regarding freedom to operate and non-infringement opinions.
Cody brings experience as a former life sciences researcher, allowing him to work closely and connect with inventors across all technologies. Much of Cody’s research focused on the development of novel therapeutics to combat antibiotic resistance. He further studied the response of metalloproteins, especially hemoglobin and mitochondrial enzyme complexes, to environmental and occupational toxicants such as cyanide, azide, and phosphine. Cody’s research involved studying the sub-molecular, molecular, and cellular mechanisms of intoxication of toxicants and developing potential antidotes.

- Counsel for patent owner against accused infringer in case relating to solar technology.
Conduct non-infringement, freedom to operate, and invalidity opinions on United States and international patent applications. - Advise clients regarding FDA related procedures, including Patent Term Extension applications and Orange Book analysis.
- Manage and prosecute patent portfolios of pharmaceutical and life sciences clients, including universities, start-ups, and publicly traded companies.
- Draft and prosecute patent applications in the areas of pharmaceutical, life sciences, inorganic and organic chemistry, computer software, medical devices, cosmetics, and industrial engineering.
