Overview

Trevor Bannister specializes in intellectual property law, including all areas of IP protection, enforcement, and commercialization strategies across patent, trademark, copyright, and trade secret law. Trevor specializes in advising clients on the development, management, and protection of domestic and international patent portfolios. He has extensive experience in preparing and prosecuting patent applications across a diverse range of technologies, including artificial intelligence and machine learning (AI/ML), computer hardware and software, processor and electrical circuitry, memory systems, cloud computing applications, power equipment and circuit protection devices, electrical systems, robotic and computer vision technologies, bioprocessing systems and equipment, medical devices, and mass spectrometry systems.

Trevor has experience counseling many different types of clients, spanning from startups to international corporations, advising management teams on different IP matters that arise during technology development, product launches, and day-to-day business operations. This experience includes IP licensing, litigation and AIA trial support, IP due diligence, and preparing legal opinions on patentability, freedom-to-operate, non-infringement, and invalidity.

Prior to practicing law, Trevor worked as a controls system engineer designing and implementing electrical control systems and associated software platforms used to operate pharmaceutical manufacturing equipment. He also worked in the Information Technology (IT) sector as part of a team managing a corporate network, along with its associated computing and network communications equipment.

Trevor’s experience provides him with the ability to develop comprehensive business strategies for growing and protecting IP assets and effective solutions for solving complex client legal issues.

Representative Matters

  • Provided comprehensive and strategic counseling for clients to develop, manage, and protect U.S. and international patent portfolios, including in Australia, Brazil, Canada, China, the European Patent Office (EPO), Japan, Mexico, South Korea, and the United Kingdom
  • Conducted patentability and invention harvesting analyses with client research and development teams to capture and protect evolving and emerging technologies
  • Assisted in developing and implementing comprehensive intellectual property strategies to protect inventions integrating AI/ML into existing technology systems, including financial technologies, medical devices, surgical systems, clinical research, and healthcare technologies
  • Handling subject matter eligibility (Section 101) issues for software and AI/ML technologies
  • Prepared legal opinions on patentability, freedom-to-operate, non-infringement, and invalidity
  • Provided patent litigation research and analysis support to litigation teams, and participated in AIA trial proceedings, including Inter partes review (IPR) proceedings
  • Negotiated and drafted intellectual property licenses, including agreements relating to patents, trademarks, copyrighted works, and proprietary data
  • Managed and developed domestic and international trademark portfolios, and performed trademark clearance analyses
  • Counseled a large international corporation on diverse copyright issues for graphical, architectural, and structural creative works
