Overview

With a wealth of over 35 years of experience, Andrew Worek is a seasoned attorney specializing in defending healthcare providers in complex medical malpractice cases, including those involving emergency medicine, healthcare administration, and psychiatric malpractice. He defends clients in the trial courts of Pennsylvania and New Jersey and the state and federal appellate courts and has successfully defended clients at trial, mediation, and arbitration.

Andy’s clients include hospitals, health systems, physicians, physician assistants, nurses, psychiatrists, and psychologists. He also defends physicians, psychiatrists, and psychologists in licensure complaints and investigations related to clinical performance and allegations of ethical violations.

Previously, Andy served as in-house counsel for a large, Philadelphia-based health system, managing and providing counsel on medical malpractice, professional liability, general liability, and miscellaneous litigation matters. He regularly represented physicians and hospital staff at court hearings, depositions, and trial testimony. Andy’s responsibilities also involved operational matters, such as daily evaluation and decisions on informed consent issues, child abuse reporting, and HIPAA compliance.

Andy’s experience as a pilot and member of the Civil Air Patrol, the civilian auxiliary of the United States Air Force, has given him a unique perspective. He has participated in search and rescue operations and served as the Civil Air Patrol’s National Legal Officer, providing counsel to the organization and its Board of Governors. Andy also served as a firefighter and in fire rescue operations.

  • Successfully defended obstetrician gynecologist against claims of improper delivery with shoulder dystocia, and brachial plexus nerve injury in neonate.
  • Successfully defended primary care physicians against claims of improper follow-up in high-risk breast cancer patient with allegations of delay in diagnosis.
  • Successfully defended surgeon against allegations of retained foreign body during mastectomy surgery.
  • Successfully defended surgeon against claims of post-operative complications following bowel resection surgery.
  • Successfully defended neurologist against claims of delay in diagnosis of rare neuro-metabolic condition with vision impairment.

Interests

In addition to his legal career, Andrew and his wife operate their family horse farm where they breed, raise, train horses.  They participate in the Retired Racehorse Project and its Thoroughbred Makeover Program which offers retired racehorses a new lease on life as pleasure riding and show jumping horses.  They have also participated in training wild mustangs as pleasure riding and show jumping horses.  Andrew has been an active supporter and participant in the Toys for Tots program for many years. Andrew is also an avid photographer and has traveled extensively to capture the beauty and diversity of locations and cultures around the globe.
