Overview
Anthony D’Elia’s litigation practice spans commercial litigation matters, shareholder disputes, bankruptcy and creditors’ rights, regulatory litigation, construction, product liability, and professional liability.
He represents both creditors and debtors in bankruptcy proceedings and loan disputes, manages receivership appointments, and handles debt collection and settlement enforcement. His practice includes both prosecuting and defending against shareholder claims, resolving construction disputes involving defective work and damages, and handling product liability defense. In regulatory matters, he has represented utility providers, utility customers, and the owners of solar energy projects in matters before both the New Jersey Board of Public Utilities and the Superior Court of New Jersey, Appellate Division. In professional liability matters, he has experience with engineering and accounting cases.
His pro bono work includes representing incarcerated individuals in assault claims, pursuing bankruptcy judgments, and negotiating family court plea bargains.
Following law school, Anthony served as law clerk to the Hon. Garry J. Furnari, J.S.C., who managed both civil and environmental dockets for Essex County Superior Court. During his clerkship, Anthony mediated small claims and law division matters, drafted legal documents, and gained extensive exposure to court proceedings across multiple practice areas including tort, contract, property, insurance, and environmental law.
Representative Matters
- Represented a Milan, Italy-based modeling agency in a chapter 11 bankruptcy proceeding and successfully defeated efforts by a creditor to organize a class action.
- Succeeded in defending the majority shareholders of a family-owned banquet hall against claims of minority shareholder oppression, winning on summary judgment.
- Represented a major cable television provider in a contract and rate dispute with a New Jersey town, obtaining a favorable result via both litigation before the New Jersey Board of Public Utilities and the Superior Court of New Jersey, as well as through settlement.
- Represented a pharmaceutical company in a contract dispute with a California-based adversary that resulted in settlement.
- Successfully represented a major New Jersey university in a constitutional rights dispute, winning on a motion to dismiss the complaint for failure to state a claim.
