Zachary M. Wallack

Overview

Zachary Wallack is a commercial litigator and first-chair trial lawyer who represents businesses and individuals in connection with their most challenging matters in state and federal courts, before administrative agencies, and in arbitration and mediation.  He handles matters involving business torts and contract disputes, construction and real estate litigation, employment and wage-and-hour disputes, and various other complex commercial matters.

Zach represents clients across a range of industries. His clients include closely held businesses, gaming companies and casino operators, national corporations, developers, general contractors, and CEOs.

Zach also maintains an active construction practice.  His construction practice includes counseling clients on risk management, advising on compliance, reviewing insurance programs, and drafting construction contracts.  When disputes arise, he represents general contractors, subcontractors, architects, developers, property owners, and other industry participants in complex litigation involving contract disputes, delay and lost productivity claims, payment claims, and construction defects.

Prior to entering private practice, Zach served as an Assistant District Attorney in the Suffolk County District Attorney’s Office, where he tried more than 50 jury trials to verdict.  He also teaches trial advocacy through the National Institute of Trial Advocacy’s Boston Trial Program.

• Represented multiple schools and senior administrators in high-profile, highly publicized litigations, achieving a favorable results and successfully navigating reputational and public-relations considerations.
• Represented a leading provider of online sports contests in complex regulatory and litigation matters.
• Represented employers in state and federal court wage-and-hour class and collective actions, including matters involving employee classification, overtime violations tip practices, and alleged violations of federal and state wage laws.
• Represented a public-access television station in high-profile federal litigation against the Town of Stoughton involving First Amendment, civil rights, defamation, and contractual claims.
• Represented the owner and operator of multiple manufactured housing communities in high-stakes putative class-action litigation involving statutory and regulatory issues under Massachusetts law.
• Represented commercial landlords in high-stakes lease disputes, securing recoveries in the millions of dollars.
