Overview

Zachary Wallack has significant experience in all phases of complex litigation. He is an experienced litigator and trial attorney who represents corporate and individual clients in state and federal trial and appellate courts, administrative proceedings, and at arbitration and mediation.  Zach also counsels businesses involved in government investigations, including those conducted by the U.S. Department of Labor, Wage and Hour Division (WHD), the Massachusetts Commission Against Discrimination (MCAD), and the Massachusetts Department of Early Education and Care (DEEC).

Zach also has significant experience with construction litigation, representing general contractors, subcontractors and property owners, and others in contract disputes, construction defect cases and premises liability matters.

In addition to his litigation practice, Zach is a member of the Gaming Group.  He has extensive experience assisting clients with license applications before regulatory bodies, contested enforcement matters, rulemaking proceedings, and regulatory review.

Zach also teaches trial advocacy to lawyers on behalf of the National Institute of Trial Advocacy (“NITA”) at NITA’s Boston Trial Program.

Prior to entering private practice, Zach was an Assistant District Attorney in the Suffolk County District Attorney’s office. There, he served as the Chief of the Gun Prosecution Task Force, a specialized unit focused on prosecuting individuals charged with illegal firearm possession and tried more than fifty jury trials to verdict.

Representative Matters

  • Obtained favorable results in trials, mediations and arbitrations for a wide variety of clients including general contractors, construction companies and transportation companies in actions involving wrongful death, catastrophic injuries, product liability, construction defects, premises liability and breach of contract.
  • Obtained numerous summary judgments and dismissals of general liability actions involving wrongful death, catastrophic injuries, product liability, premises liability and breach of contract.
  • Representation of general contractors in enforcement proceedings before the Massachusetts Office of Consumer Affairs and Business Regulation (OCABR).
  • Representation of insurers and insureds in first-party litigation and in third-party litigation.
  • Represents casinos, gaming manufacturers, lottery operators and vendors on various matters before regulatory agencies.
  • As an assistant district attorney, Zach tried over fifty jury trials to verdict, and many more to verdict before a judge.
