WARN Act: Class Action Lawsuits Loom as Furloughs Approach Six Month Mark

As businesses struggle to adapt to the challenges imposed by the COVID-19 pandemic, a new threat is on the horizon – a potential deluge of class action lawsuits claiming violation of the WARN Act and its state law counterparts. As many worker furloughs implemented in March and April continue due to the ongoing economic uncertainty and government-imposed restrictions, employers are rapidly approaching the six month mark when even temporary furloughs are deemed an “employment loss” under WARN, triggering its notice requirements. Failure to comply with those obligations results in automatic damages and attorney’s fees, a perfect storm for class action lawsuits.
