WARN Act: Class Action Lawsuits Loom as Furloughs Approach Six Month Mark
DATE: September 10, 2020
TIME: Noon - 1:00 p.m. EST
LOCATION: Complimentary Zoom webinar
As businesses struggle to adapt to the challenges imposed by the COVID-19 pandemic, a new threat is on the horizon – a potential deluge of class action lawsuits claiming violation of the WARN Act and its state law counterparts. As many worker furloughs implemented in March and April continue due to the ongoing economic uncertainty and government-imposed restrictions, employers are rapidly approaching the six month mark when even temporary furloughs are deemed an “employment loss” under WARN, triggering its notice requirements. Failure to comply with those obligations results in automatic damages and attorney’s fees, a perfect storm for class action lawsuits.
Please join Eckert Seamans attorneys Michael D. Jones, Lindsey Conrad Kennedy, and Ryan J. Cassidy on Thursday, September 10, 2020 at Noon for a complimentary webinar where we will answer businesses’ most pressing questions:
- Are we covered by WARN or similar state laws?
- Have our layoffs or furloughs put us at risk of a WARN Act violation and potential class action lawsuit?
- Are there any exclusions or defenses that might apply to our situation?
- What steps do we need to take now?
- How do we protect ourselves and mitigate risk?
