Overview
With a focus on commercial litigation, Megan Padgett’s experience spans transportation law, complex construction litigation, insurance coverage, and appellate matters. She is skilled at identifying areas of exposure and developing and implementing fact-specific investigation and litigation strategies to mitigate risk and exposure throughout the course of litigation.
Prior to joining the firm, Megan was at a Pittsburgh-based boutique transportation law firm. She has appeared in numerous state and federal courts across Pennsylvania and West Virginia, in a broad spectrum of general litigation matters, including contract disputes, products liability, and personal injury matters.
In law school at Penn State Law, Megan focused her studies on advanced torts and trial advocacy. She also worked in the Penn State Law International Sustainable Development Clinic, working collaboratively with Penn State engineering students and MBA students to implement cutting-edge medical supply access projects and sustainable business innovations in rural areas of Kenya.
Representative Matters
- Represented a nationwide transportation and logistics company in collection of costs associated with environmental cleanup of liquid mercury under the Comprehensive Environmental Response and Cleanup Act from responsible party.
- Represented numerous trucking and transportation companies in immediate catastrophic loss response and exposure mitigation prior to litigation with potential eight-figure exposure, through strategic and detailed post-accident evidence preservation and investigation.
- Representation of insurance company in enforcement and collection of Site Reclamation Bonds from insureds following the conclusion of insureds’ mining activities.
- Representation of a construction company in relation to a warehouse collapse that caused multiple worker fatalities in complex, multi-phase litigation.
