Overview
Michael Alberico’s practice focuses on litigation, including commercial disputes and construction claims. Michael’s legal work also includes municipal and land use law. He also has experience in counseling business clients regarding waivers and risk management. Michael’s litigation style focuses on working with clients to find the most effective solutions that best suit the client’s needs.
He also works with a local municipality handling certain litigation matters and tax appeal disputes. In addition, he handles property tax appeals at both the county and state levels for local businesses. Michael also has experience with real estate transactions.
During his time in law school, he served as the Rutgers Journal of Law and Religion’s Editor-in-Chief. After law school, Michael served as a law clerk to the Honorable Carol E. Higbee in the New Jersey Appellate Division. Prior to joining Eckert Seamans, Michael worked for a large litigation firm defending businesses and individuals against liability claims. Before attending law school, Michael built a professional foundation in the hospitality industry, with experience spanning alcohol sales and service operations.
Representative Matters
- Obtained dismissal following trial of a commercial landlord’s million dollar claim regarding a lease renewal on behalf of a commercial landlord tenant.
- Obtained summary judgment on behalf of a motor vehicle auction house by arguing the client’s contractual and statutory duties barred Plaintiff’s tort claims.
- Successfully obtained affirmance on an appellate motion seeking to overturn the applicability of an arbitration clause in a motor vehicle wholesale auction contract.
- Successfully obtained summary judgment in defense of a national truck manufacturer on product liability claims.
- Successfully obtained dismissal after filing a preliminary motion of a claim against a construction company on statute of limitations grounds.
- Successfully obtained dismissal of a breach of contract claim brought by a subcontractor against a general contractor on theories of offer and acceptance.
- Successfully obtained a property tax exemption for a religious school organization.
- Successfully obtained reversal on appeal of a manufacturing client’s land use variance application and persuaded the New Jersey Supreme Court to deny the competitor’s petition for certification.
- Successful defense of clients on appeal through the affirmance of a motion for summary judgment ruling dismissing claims against the clients involving care provided to developmentally disabled individuals.
- Successfully obtained a no cause of action at trial in favor of his client, a repossession company, by successfully defending its interests against claims of theft and automobile damage.
- Represented a client at a bench trial against a post settlement indemnification claim involving complex and novel common law and contractual risk transfer disputes.

Community Involvement
Michael volunteers his time at Bancroft, where he assists individuals with autism, acquired brain injuries, and other developmental disabilities in extracurricular activities, including coaching the adult program’s track team for participation in the Special Olympics. He is also a member of the Haddonfield, NJ Historic Preservation Commission.
