Overview

Rob Hannen has extensive trial and appellate litigation experience in federal and state courts. He represents mid-size and large companies, including Fortune 100 and Fortune 500 companies, in commercial and employment-related litigation involving disputes ranging in amounts up to several hundred million dollars.

He has represented financial institutions in litigation involving defense of allegations of breach of contract, predatory lending, fraud, wrongful foreclosure, wrongful dishonor of checks, and violations of consumer credit protection laws. Rob also has represented financial institutions in foreclosure and bankruptcy matters and has litigated a number of cases to verdict, including as lead trial counsel in class action litigation.

  • Represented international company in federal court litigation involving claims in excess of $400 million arising from allegations of breach of contract and conversion in sale of goods.
  • Represented global manufacturer in commercial arbitration involving pricing disputes exceeding $130 million.
  • Represented global manufacturer in federal court litigation involving claims of breach of contract, misrepresentation, unjust enrichment, and pricing disputes in excess of $90 million.
  • Represented manufacturer in commercial arbitration involving allegations of supply of non-conforming goods and damages in excess of $80 million.
  • Represented health system in federal court litigation alleging breach of contract damages in excess of $40 million in supply of services to health system and its benefit plan.
  • Represented health system in state court litigation alleging breach of contract, fraud, and misrepresentation, seeking damages in excess of $25 million.
  • Represented coal company in deliberate intent claim seeking in excess of $12 million in damages for injuries sustained by worker in rock fall.
  • Represented company in state court litigation alleging breach of lease agreement seeking $8.5 million in damages.
  • Represented company in commercial arbitration involving allegations of breach of requirements contract and damages in excess of $8 million.
  • Represented company in breach of contract claim involving sale of goods seeking in excess of $6 million in damages.
  • Represented company in federal court litigation alleging fraud and misrepresentation, seeking damages in excess of $3 million.
  • Represented European manufacturer of industrial equipment in defense of multimillion-dollar wrongful death claim alleging product defect and design.
  • Represented owner of industrial facility in multimillion-dollar wrongful death and personal injury claims filed by workers arising from explosion at site.

  • Represented financial institution in class action alleging violations of consumer protection laws and damages in excess of $60 million.
  • Represented financial institution in work out, restructuring, and lender liability claim involving $20 million loan.
  • Represented financial institution in litigation involving swap agreements, LIBOR, and claims of lender liability; breach of contract; and fraud; seeking damages in excess of $16 million.
  • Represented financial institutions in numerous claims involving Articles 3, 4, and 9 of the Uniform Commercial Code (UCC).
  • Represented financial institutions in numerous matters alleging fraud, breach of contract, and tortious interference.
  • Represented financial institutions in numerous matters alleging forgeries, stolen checks, alterations, fraudulent endorsements, imposters, fictitious payees, and wrongful dishonor of checks.
  • Represented financial institutions in claims involving breaches of affirmative covenants, negative covenants, and financial covenants, including tangible net worth, debt service coverage ratios, debt to EBITDA ratios ,and debt to equity ratios in loan documents.
  • Represented financial institutions in numerous matters alleging conversion claims under the UCC.

Employment Litigation

  • Represented employers in federal and state courts in litigation concerning wrongful discharge.
  • Represented employers in federal and state courts on charges of age, sex, and racial discrimination.
  • Represented employers in numerous cases involving Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), and Fair Labor Standards Act (FLSA) claims.
  • Represented employers in claims of violations of Uniformed Services Employment and Reemployment Rights Act (USERRA).
  • Represented employers in litigation in federal and state courts seeking injunctive relief and damages arising out of violations of restrictive covenants including non-competition, non-solicitation, non-disclosure, and trade secret covenants in employment agreements.
  • Represented employers in defense of matters before U.S. Equal Employment Opportunity Commission (EEOC), Department of Labor, and numerous state agencies.
  • Represented companies in federal and state court litigation in claims of wrongful death and serious injury in the workplace including allegations of deliberate intent to injure, product defects, and negligence.
  • Represented global manufacturer in arbitrations under collective bargaining agreements and in labor disputes.
  • Represented employers in regard to workers compensation claims.

Benefits Litigation and Health Care

  • Represented managed care organizations and health care companies in multiple class actions involving ERISA, Medicare, Racketeer Influenced and Corrupt Organizations Act (RICO), and state insurance practices claims.
  • Represented managed care organizations, health insurers, plan administrators, and self-funded plans in multiple actions claiming wrongful denial of benefits, violations of ERISA, violations of state insurance laws, breach of contract, and medical malpractice claims.
  • Represented numerous managed care organizations, health insurers, and self-funded employee benefit plans in litigating third-party reimbursement claims.
  • Represented managed care organizations, health insurers, and third-party administrators in litigation concerning ERISA, COBRA, Medicare, Federal Employee Health Benefits Act, HIPAA/privacy issues, and multiple employer welfare arrangements (MEWAs).
  • Represented managed care organizations and physician organizations in antitrust litigation.
  • Represented managed care organizations, health insurers, and third-party administrators in defense of claims of fiduciary violations.
  • Represented third-party administrator of church group welfare benefit plan in litigation alleging violations of state insurance laws and regulations.
  • Represented managed-care organization in litigation concerning ERISA preemption of claim of vicarious liability for medical malpractice.
