Overview

April Morgan Hincy is vice chair of the Financial Services Litigation Group and handles all aspects of state and federal commercial litigation in a broad range of areas, including business disputes, contested foreclosures, lender liability, predatory lending, bankruptcy, real estate, oil and gas, coal rights, timber rights, landlord-tenant disputes, class actions, products liability, mass tort, construction, mechanic’s liens and bond claims, collections, labor and employment, estates and trusts, intellectual property, professional liability, and insurance coverage.  She also handles real estate transactions, advises on regulatory compliance, negotiates leases and supply contracts, develops employment policies and procedures, and drafts employee handbooks.  April also advises clients on compliance with various state and federal laws and regulations, including EEOC, FLSA, ADA, Title VII, EPA, ADEA, FDCPA, FCRA, HMDA, HAMP, RESPA, TILA, FCRA, EFTA, PA UTPCPA, and ECOA.

Representative Matters

  • Serve as counsel for nationwide financial institutions and servicers in lender liability, contested foreclosures, and bankruptcy litigation.
  • Serve as counsel in class actions involving medical records, electronic funds transfer, consumer finance, antitrust, insurance coverage, and toxic tort litigation.
  • Represent secured and unsecured Creditors in Chapter 7, Chapter 11, and Chapter 13 bankruptcy cases.
  • Serve as counsel in litigation involving, coal, timber, and oil and gas rights, including Marcellus Shale.
  • Counsel and litigate in the areas of corporate governance, fiduciary duty, lender liability, mortgage backed securitizations, real estate, leasing, consumer finance, fair credit reporting, bankruptcy, contested foreclosures, contracts, professional liability defense, insurance coverage, risk allocation and loss prevention, collections and workouts, toxic tort, wage and restrictive covenants, trademark, advertising and FTC compliance, construction, and transportation.
  • Defend contractors, engineers, and architects in construction and professional liability claims.
  • Serve as counsel in international medical device infringement litigation.
  • Defend hospitals, physicians, and dentists in medical malpractice claims.
  • Counsel clients on compliance with Stark, Anti-Kickback, FLSA, WVWPCA, Title VII, EPA, ADEA, and ADA.
  • Prepare Opinions of Title for lenders.
  • Represent businesses in worker’s compensation and unemployment claims.
  • Defend employers in EEOC claims.
