Manufacturers’ Liability After NJ Asbestos Warning Ruling

Mike Posavetz recently authored an article for Law360 entitled “Manufacturers’ Liability After NJ Asbestos Warning Ruling.” The New Jersey Supreme Court held earlier this summer in Fowler v. Akzo Nobel Chemicals Inc., that adequate warnings regarding the hazards of asbestos must be provided to the end user, and not just the end users’ employer. The court noted this dual warning requirement, which is “now well ingrained in our law,” is warranted as employees are not able to rely solely on their employer to assure their health and safety, even when their employer was adequately warned.
