The firm has represented clients in a variety of environmental enforcement actions and regulatory and permit proceedings before federal and state courts and administrative tribunals under all of the major environmental programs including matters involving Reasonably Available Control Technology (RACT) and Best Available Control Technology (BACT) disputes and new source review and new source performance standard triggers under the Clean Air Act, wet weather inflow and infiltration issues and BACT and other effluent limitation disputes under the Clean Water Act and a variety site remediation projects and cost allocation disputes under the various state brownfields and cleanup programs and CERCLA. The firm has a long history of successfully defending environmental nuisance claims and associated class actions and citizens’ suits, and our environmental lawyers work closely with our white collar crime group in evaluating and defending matters where criminal enforcement is implicated.
The firm’s environmental lawyers also work closely with our corporate business attorneys to assist in due diligence and the evaluation of environmental risk in a variety of business transactions including environmental issues related to public offerings and public disclosures, the negotiation of terms and conditions in asset and stock purchase agreements, and providing the assistance needed to resolve environmental issues and facilitate the successful closing of transactions.
