Document Retention Strategies for Healthcare Providers and the Consequences of Failing to Preserve Discoverable Information - 11:00 a.m. - 12:00 p.m.

Course Description: 

Dale Hershey will discuss the requirements of the Foreign Corrupt Practices Act, the penalties for violations, enforcement procedures by the Justice Department and the Securities and Exchange Commission, recent cases brought under the Act, other steps taken by international organizations against corruption and bribery, and checklists for people involved in international trade to enable them to avoid problems under the Act.

Mark Willard will discuss the healthcare provider's special requirements to preserve information and the requirements of a compliant document retention policy. Tom O'Connor will discuss the duty to preserve information when litigation can be reasonably anticipated and recent decisions imposing sanctions for the inability or failure to respond to electronic discovery requests.
