Smoking Policy

As many of you know, as of January 1, 2007, most companies located in Allegheny County will be affected by recently-passed legislation banning smoking in the workplace.  In order to minimize legal risk, every company should have a policy in place prior to January 1.  As a courtesy to clients and friends, Eckert Seamans has provided the below general policy for your use.

Sample Policy on Smoking in the Workplace

All employees are advised that, effective January 1, 2007, smoking of cigarettes, cigars, pipes or other smoke-producing products within the company’s offices is prohibited.  This prohibition applies to all employees, regardless of level, to clients and to other visitors.

Employees are encouraged to report violations of this policy to the Company President, the Director of Human Resources or to the Chief Operating Officer.  A prompt investigation will be made and appropriate corrective action will be taken.  Violators of this policy will be subject to disciplinary action, up to and including discharge.  There will be no retaliation against any employee who makes a good faith report of a violation of this policy to the appropriate person.
