Scott R. Dismukes is a Member of the firm’s Litigation Division and Chair of the Energy Group. Mr. Dismukes concentrates his practice on environmental litigation and counseling issues and has done so since 1986. He provides litigation compliance, and environmental business counseling to industrial clients under all federal and various state’s environmental laws. Mr. Dismukes devotes significant time to the negotiation, prosecution and defense of environmental permit and regulatory challenges, the defense of federal and state enforcement actions, representing clients in remedial and corrective action matters, and advising clients regarding environmental considerations in business transactionsMr. Dismukes has represented clients regarding environmental issues before the U.S. EPA and state governmental agencies as well as before federal and state courts. He has extensive experience under the Clean Air Act and Clean Water Act as well as EPCRA, TSCA, RCRA, CERCLA and self-disclosure under U.S. EPA and various state policies. As a result of working on these multimedia and multidisciplinary efforts, Mr. Dismukes has significant experience working with experts and consultants from many disciplines including engineering, analytic and applied chemistry, geology and hydro-geology, biology, limnology, toxicology, dispersion modeling and meteorology.
Previously Mr. Dismukes was an Assistant Regional Counsel for U.S. EPA, Region V, conducting enforcement actions pursuant to CAA, CWA, EPCRA, TSCA, and FIFRA, was Region V’s primary liaison for EPCRA litigation enforcement, and was Regions V’s member to EPA’s National Workgroup redrafting various penalty policies. He has done extensive work on economic benefit and ability to pay issues. He is the recipient of the U.S. EPA’s bronze medal service award for his work under the CWA. Mr. Dismukes also clerked for the Honorable Justin M. Johnson of the Superior Court of Pennsylvania.
Mr. Dismukes has provided numerous presentations regarding the Clean Water Act, the Clean Air Act, the Toxic Substances Control Act, the Resource Conservation Recovery Act, enforcement, environmental management systems, auditing and self-disclosure issues and the impact of Sarbanes-Oxley, and environmental issues in Real Estate transactions and development.
